This unit of the District Attorney's Office was opened to assist creditors in making bad checks good.  We hope we are able to help you.
 
BAD CHECK UNIT CHECKLIST
 
The transaction must have taken place in Bolivar, Coahoma, Quitman or Tunica Counties.
 
We request that you file a complaint with the District Attorney promptly.  If at all possible, we ask that you obtain with your Complaint within sixty(60) days of the check date.  It has been established that checks more than six(60) months old are very difficult to investigate.
 
All bad checks must be stamped:
Insufficient funds
Account Closed
 
Checks will not be accepted if they are stamped:
Stop payment
Uncollected funds
Refer to maker
No such account(usually counter checks)
 
The following checks will not be accepted:
Checks on which partial payments have been made
Postdated checks
Two party checks
Forgeries(all forgies should be forwarded to appropriate law enforcement agencies
 
The check writer must be eighteen(18) years of age on or before check date.
 
A fifteen working day legal notice(in the exact form as the one attached in this packet) must be mailed by certified mail, return receipt requested, or by sworn affidavit to the exact address given on the check by the maker.  (The name, residence address, mailing address and home telephone number of the check writer must be printed or written on the check at the time it is given unless the check writer has a check cashing identification card issued by the receiving party with this information on file.)
 
If the certified letter(notice) is returned undelivered, no waiting period is required and you may file a complaint at that time.
 
You must bring or mail the following when presenting a complaint to the District Attorney in the following order:
Original Check
Copy of Certified 15 day legal notice letter
Completed Bad Check Complaint
Certified mail receipt(proof of purchase) or
Sworn Affidavit or
Return receipt requested card(green card) if signed for.  If the certified letter is returned
unclaimed, send the unopened letter.
 
A bad check complaint must be filed in our office for each check you wish to submit to the District Attorney.
 
If after filing a Complaint with the District Attorney, you wish to withdraw the complaint for good cause, Mississippi Law requires that you pay a fee of thirty($30) dollars to the District Attorney for processing.  The law provides this avenue as an additional tool for obtaining restitution on bad checks.  It is in addition to existing law but does not supplant it.  The merchant or individual is still at liberty to pursue conventional criminal prosecution if for any reason it is deemed to be more appropriate in a given case.  If you choose to prosecute criminally, go to the appropriate law enforcement agency as you have done in the past.
